Sub:- Procedure to be followed by Employees Compensation Courts- directions of the Honourable Supreme Court of India in Suo Motu W.P. (C) No.7 of 2024 titled in Re: Compensation amounts deposited with Motor Accidents Claims Tribunals and Labour Courts-Reg.
Ref:- Orders dated 22.04.2025 and 18.08.2025 of the Honourable Supreme Court in Suo Motu W.P.(C) No. 7 of 2024.
In compliance with the directions issued by the Honourable Supreme Court in the orders referred above, the following Practice Directions are laid down for being followed by all the Employees Compensation Courts in the State of Kerala , with effect from the date of this O.M.
These Practice Directions, originally issued for the conduct of proceedings under the Employees' Compensation Act, 1923, shall, unless the context otherwise requires, apply mutatis mutandis to all corresponding proceedings initiated, pending, or hereafter brought before the Competent Authority appointed under Section 91 read with Section 2(16) of the Code on Social Security, 2020 (Act 36 of 2020), for the adjudication of claims relating to Employees' Compensation under Chapter VII of the said Code, as if the references to the 'Employees' Compensation Commissioner' and 'Employees' Compensation Courts' were references to the 'Competent Authority' under the Code.
PRACTICE DIRECTIONS FOR EMPLOYEES COMPENSATION COURTS IN KERALA
PROCEDURE BEFORE PASSING THE FINAL AWARD
1. (a) All the Employees’ Compensation Commissioners shall ensure that at the time of filing the application, in addition to the existing particulars as required under Section 22 of the Employees’ Compensation Act and Kerala Employees’ Compensation Rules 1958, the Aadhaar Number, PAN details and e-mail ID, if any, of all the applicants seeking compensation including the employees, dependents of the deceased employee, as the case may be, shall also be incorporated in the application for compensation.
(b) Such particulars shall also be furnished by any person seeking to get impleaded in the application as a supplemental/ additional applicant.
(c) The Employees’ Compensation Commissioner shall register and number the application, even though the details as mentioned in clause l (a) are not furnished at the time of filing.
(d) In the application, where the details as mentioned in clause 1 (a) are not furnished, the Employees’ Compensation Commissioner while holding preliminary enquiry on the application shall direct the applicant(s) to furnish the same within a reasonable time as specified by the Employees’ Compensation Commissioner.
Note: The office shall not send notice to the opposite parties until and unless the direction of the Commissioner to furnish such particulars is complied with.
2 (a) Before commencement of the trial or before passing an order granting compensation, whichever is earlier, the Employees’ Compensation Commissioner shall call upon the applicants, within a reasonable time as specified by the Commissioner, to produce their account details in a nationalized bank /scheduled bank as mentioned below along with a certificate of the banker giving details of the bank account.

(b) The Employees’ Compensation Commissioner shall further direct the applicants to promptly notify him regarding change if any in the bank account details, email ID, or any other particulars already furnished.
(c) The Employees’ Compensation Commissioner shall verify and ascertain that the bank account(s) belonging to such applicants. The Employees’ Compensation Commissioner shall also ensure that no person other than a dependent/legal heir of the employee is included as a joint account holder in such bank account(s). If the applicant(s)/dependent(s) is a minor, mentally ill, or otherwise disabled to open a bank account in his/her name the account shall be opened in the name of such person represented by a guardian. Whenever a new person is added to such account(s), the applicant(s) or the guardian, as the case may be, shall inform the Commissioner about such addition, specifying the reason for the addition and the relationship of the newly added person. Any deletion of a person from such an account(s) shall also be so informed.
d) In the event a consent award, the consent terms must contain all relevant account details of the employee/dependents of the employee entitled to receive compensation in accordance with clause 2 (a).
The account details shall also be incorporated in the order/award passed by the Employees’ Compensation Commissioner for disbursement of the amount based on a compromise between the parties. In the event of a compromise before the Lok Adalat, the Commissioner on the basis of settlement, shall pass a consequential order/award incorporating the terms of settlement. The award passed by the Commissioner shall contain the account details of the employee/dependents/legal heirs of the employee who is entitled to receive compensation under the order/award
(e) In the case of application for compensation towards death of employee , once the enquiry is completed regarding the dependents of the deceased employee and a decision thereon is made by the employees compensation commissioner, the procedure laid down in clauses 2(a) to 2(c) above, regarding the collection of details of the bank account(s) shall be followed.
f) All the procedures mentioned in 2(a) to (e) shall be completed before passing the order/award in the application.
PROCEDURE AFTER PASSING THE ORDER/AWARD
3(a) After the award is passed, if the Employees’ Compensation Commissioner finds that any employee, dependent(s) or legal heir(s) of the deceased employee is entitled to receive compensation, the Commissioner shall obtain the particulars mentioned in clauses l(a) and 2 (a) from such parties before disbursing the compensation awarded.
(b) If, after the award is passed, but before the compensation is disbursed, any of the persons entitled to receive compensation dies, the Employees’ Compensation Commissioner shall obtain the particulars mentioned in clauses 1 (a) and 2 (a) above from the legal heir(s)/legal representative(s) of such person(s) before disbursing the compensation awarded.
(c)The Employees’ Compensation Commissioner shall, in the ordinary course, while issuing directions regarding disbursement of compensation in the final award or in any subsequent orders, direct the transfer of the requisite amounts directly to the bank account of the person/s entitled to receive compensation as per the account details furnished in clause 2 (a) above. Where there is a considerable lapse of time between the furnishing of bank account details and the filing of an application for withdrawal, the Employees Compensation Commissioner shall take reasonable steps to ascertain and obtain the claimant(s)' updated account details.
(d) Whenever the Employees’ Compensation Commissioner passes an order of deposit of compensation amount (especially in the case of a minor, mentally ill person or any other person), with the Commissioner or in the name of the person(s) entitled to receive compensation or in the joint name of the person(s) entitled to receive compensation, there shall be a direction to invest the amounts in fixed deposit with any nationalized bank/scheduled bank where the deposit fetches maximum interest of which the details are furnished. The Commissioner can also direct that the fixed deposit shall have a lien marked on the face of the receipt and that the amount shall be paid only on the date as directed in the award or on the orders of the Commissioner.
(e) The fixed deposit shall carry standing instructions for automatic renewals at periodic intervals, securing the maximum rate of interest, until further orders are passed by the Employees’ Compensation Commissioner. When the Employees’ Compensation Commissioner considers it appropriate to permit the withdrawal of interest accrued on the fixed deposit, the bank shall, upon the order of the Commissioner, transfer the said amount to the account specified in the order of the Tribunal. Upon the minor attaining majority, the bank shall credit the fixed deposit amount together with accrued interest to the person's account, unless otherwise directed by the Tribunal.
(f) The transfer of the amount in the bank account, particulars of which have been furnished by the applicant(s), dependent(s), legal heir(s) of the employee, opposite party(s), as mentioned in the award/orders, shall be treated as satisfaction of the award/orders.
(g) Upon deposits being made, the opposite party(s) concerned shall submit to the Commissioner a copy of the bank advice and a memo in the prescribed format provided below. A copy of the payment advice, along with a copy of the memo shall also be served on the applicant(s) and their respective counsel, if any. Memo regarding Payment advice for remittance of Compensation

4. COMPENSATON DEPOSITED BY THE EMPLOYER/INSURER WITHOUT ADJUDICATION
a. When the employer(s), insurer deposits compensation under Section 8 of the Employees’ Compensation Act with the Employees’ Compensation Commissioner , the Employees’ Compensation Commissioner on deciding to proceed with the apportioning of compensation and disbursement of shares to the dependents of the deceased, after complying with the provisions in clauses 2(a) to 2(c), shall transfer the same directly to the bank account(s) of the dependent(s). In the case of a minor, mentally ill person or any other person, in addition to the direction in clause 2(c), the directions in clause 3(d) shall be followed.
GENERAL
5(a)If any of the persons mentioned above do not have a bank account, the Employees’ Compensation Commissioner shall direct such person(s) to open a bank account within a prescribed period.
(b) If any of the persons mentioned above does not have any of the details mentioned in clauses 1(a) and 2(a), such person(s) may either directly or on the direction of the Employees’ Compensation Commissioner approach the District Legal Services Authorities (DLSA) or the Taluk Legal Services Committee (TLSC) concerned to provide necessary assistance.
6(a) The directions contained in this Circular shall be widely published on the website/web page of the Industrial Tribunals, if any, notice boards and shall also be notified to the Labour Commissioner, District Labour officer of the respective district, Bar Associations, Insurance Companies, and other entities.
(b) If any amount remains deposited in the account maintained by the Employees’ Compensation Commissioner, the Commissioner shall take steps to notify the person entitled to receive the amount to claim the said amount within a time frame to be fixed by the Commissioner. Despite such notification, if the amount is not claimed, the Commissioner shall report this fact to the Registry of the High Court.
(c) AIl the Employees’ Compensation Commissioners in the State of Kerala shall ensure strict compliance of the above directions. In case of any procedural difficulty in implementing these directions, the matter shall be brought to the notice of the Registry of the High Court.
(d) If any clarifications/directions are found necessary regarding the implementation of any of the provisions of this Circular, the Honourable the Chief Justice shall have the power to issue appropriate clarifications/directions.
