Gram Nyayalayas Act, 2008 –

Addition of certain items in Part III of the First Schedule and Part III of the Second Schedule to the Act

Notification

S.R.O. No.125/2016--Whereas, the Government of Kerala is satisfied that it is necessary and expedient to add to certain items in Part III of the First Schedule and Part III of the Second Schedule to the Gram Nyayalayas Act, 2008 (Central Act 4 of 2009);

 

Now, Therefore, in exercise of the powers conferred by sub-section(3) of Section 14 of the said Act, the Government of Kerala, in consultation with the High  Court of Kerala, hereby add the items specified in clauses (a) and (b) below, in Part III of the First Schedule and Part III of the Second Schedule to the said Act, respectively as follows:-

 

(a) In Part III of the First Schedule to the said Act, under the heading “OFFENCES AND  RELIEF  UNDER  THE  STATE  ACTS”, below the words and brackets “(To be notified by the State Government)”, the following items shall be added, namely:—

 

“(i)  the Kerala Cattle Trespass Act, 1961 (26 of 1961);

 

(ii)  the Kerala Cinemas Regulation Act, 1958 (32 of 1958);

 

(iii) the Kerala Essential Services Maintenance Act, 1994 (6 of 1994);

 

(iv) the Kerala Ground Water (Control and Regulation) Act, 2002 (19 of 2002);

 

(v) he Kerala Gaming Act, 1960 (20 of 1960);

 

(vi) the Kerala Habitual Offenders Act, 1960 (28 of 1960);

 

(vii) the Kerala Highway Protection Act, 1999 (6 of 2000);

 

(viii) the Loading and Unloading (Regulation of Wages and Restriction of Unlawful Practices) Act, 2002 (10 of 2002);

 

(ix) the Kerala Places of Public Resorts Act, 1963 (40 of 1963);

 

(x)  the Kerala Prevention of Disturbances of Public Meetings Act, 1961 (35 of 1961);

 

(xi) the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001 (19 of 2001);

 

(xii)  the Kerala Revenue Recovery Act, 1968 (15 of 1968);

 

(xiii)  the Kerala Restriction on Transfer by and Restoration of Lands to Scheduled Tribes Act, 1999 (12 of 1999);

 

(xiv) the Kerala Treasure Trove Act, 1968 (30 of 1968);

 

(xv) the Offences under the Kerala Police Act, 2011 (8 of 2011), which are triable summarily as per the provisions of the Code of Criminal Procedure, 1973 (Central Act 2 of 1974).”.

 

(a)  In Part III of the Second Schedule to the said Act, under the heading “CLAIMS AND DISPUTES UNDER THE STATE ACTS NOTIFIED UNDER SUB- SECTION (3) OF SECTION 14 BY THE STATE GOVERNMENT”, below the words and brackets “(To be notified by the State Government)”, the following items shall be added, namely:—

 

“(i)  the Kerala Buildings (Lease and Rent Control) Act, 1965 (2 of 1965);

 

(ii)  the Kerala Survey and Boundaries  Act, 1961 (37 of 1961).”.
