In exercise of the powers conferred by sub-section (1) of section 22 of the Registration Act, 1908 (Central Act 16 of 1908), the Government of Kerala hereby make the following rules further to amend the Registration Rules (Kerala), 1958, issued under notification and published in the Kerala Gazette Extraordinary No. 143 dated 27th December, 1958, namely:—

RULES

1. Short title and commencement. —(1) These rules may be called the Registration (Amendment) Rules (Kerala), 2024.

(2) They shall come into force at once.

2. Amendment of the Rules. - In the Registration Rules (Kerala), 1958, after rule 30B, the following rule shall be added, namely:—

"30C. The registering officer shall not register any instrument that involves the transfer of land situated within a village, as notified from time to time, wherein a digital survey has been duly completed and the records have been finally modified under the provisions of Section 13 of the Survey and Boundary Act, 1961, unless the said instrument is accompanied by a digitally prepared pre-mutation sketch incorporating such details as may be specified from time to time."

Explanatory Note

(This does not form part of the notification, but is intended to indicate its general purport.)

The Government have decided to incorporate digitally prepared premutation sketches in the registration process, as per G.O.(Rt) No.2035/2023/RD dated 30th May, 2023 mandatory for land transactions. All the digitally surveyed villages will be deemed as the notified areas as per section 17A of the Survey and Boundary Act,1961 immediately after the finalization of the survey record under section 13 of the said Act. Additionally, existing forms will be optimized for simplification, and a registration document template module shall be introduced. Furthermore, a common template shall be implemented for land registration in the Integrated Land Information Management System (ILIMS) as part of simplification of registration process in the State. Therefore, it has been decided to amend the registration rules accordingly to introduce digital pre-mutation sketches with measurement and area mandatory for the registration of land transactions in all villages where the digital survey has been completed, and records have been finalized and notified by the Government as such under Section 13 of the Survey and Boundary Act, 1961.

The notification is intended to achieve the above object.
