Registration Act, 1908 – Amendment to the Table of Fees Prescribed
under Section 78

NOTIFICATION
G.O.(P) No.133/2020/TAXES. Dated, Thiruvananthapuram, 8th October, 2020 S.R.O.No.679/2020
In exercise of the powers conferred by sub-section (1) of Section 78 of the Registration Act, 1908 (Central Act XVI of 1908), the Government of Kerala hereby make the following further amendment to the table of fees prescribed under Section 78 of the said Act, issued by notification under G.O.(P) No.147/77/TD, dated 23rd November, 1977 and published as S.R.O.No.1142/77 in the Kerala Gazette No.50 dated 13th December, 1977, namely:-
AMENDMENT
In the said notification, in Article I, In clause (a) after sub-clause (4), the following sub-clauses shall be inserted, namely:–
| “(5) For the registration of an agreement relating to giving authority or power to a promoter or developer for construction, development or sale or transfer of any immovable property described under clause (c) of serial number 5 of the Schedule to the Kerala Stamp Act, 1959- | |
| i. where the value of the agreement does not exceed Rupees Ten Crores | Two rupees for every rupees 100 or part thereof of the value of the agreement, subject to a maximum of rupees 25,000. |

ii. where the value of the agreement is above Rupees Ten Crores and does not exceed Rupees Fifty Crores.
|
Two rupees for every rupees 100 or part thereof of the value of the agreement, subject to a maximum of rupees 50,000. |

iii. where the value of the agreement exceeds Rupees Fifty Crores
|
Two rupees for every rupees 100 or part thereof of the value of the agreement, subject to a maximum of Rupees one lakh
|
| (6) For the registration of an agreement relating to constitution, reconstruction, amalgamation, winding up or dissolution of a Limited Liability Partnership described under serial number 35 B of the Schedule to the Kerala Stamp Act,1959. | Rupees One Thousand.” |

Explanatory Note
(This does not form part of the notification, but is intended to indicate its general purport.) In the Kerala Finance Act, 2019 (5 of 2019), an upper cap of rupees one thousand has been introduced for the stamp duty of an agreement relating to giving authority or power to a promoter or developer for construction, development or sale or transfer of any immovable property. Stamp duty has also been introduced for agreements relating to Limited Liability Partnerships. Now ,Government have decided to prescribe registration fees for the said agreements and to amend the Table of Fees prescribed under section 78 of the Registration Act, 1908, accordingly.
The notification is intended to achieve the above object.
