FOOD CORPORATION OF INDIA NOTIFICATION

No. EP-36(1)2017.—In exercise of the powers conferred by Section 45 of Food Corporations Act, 1964 (37 of 1964) and with the previous sanction of the Central Government, the Food Corporation of India hereby makes the following Regulations further to amend the Food Corporation of India (Staff) Regulations, 1971 namely:-
1. Short Title and Commencement (i) These Regulations shall be called the Food Corporation of India (Staff) (Forth Amendment) Regulations, 2018.
(ii) These shall come into force from the date of Notification in the Official Gazette.
2. Definitions - The definition and meaning of the words and designation of posts in this Regulations shall have the same meaning as contained in the Food Corporations Act, 1964 and the Food Corporation of India (Staff) Regulations, 1971.
3. In FCI (Staff) Regulations 1971 -
Regulation 74(1)(d) of the FCI (Staff) Regulations may be amended as under:
(d) pass such other orders as it may deem fit;
Provided that no order imposing or enhancing any penalty shall be made by the reviewing authority unless the employee concerned has been given a reasonable opportunity of making a representation against the penalty proposed and where it is proposed to impose any of the penalties specified in clauses (v) to (ix) of Regulation 54 or to enhance the penalty imposed by the order sought to be reviewed to any of the penalties specified in those clauses ; and if an enquiry under Regulation 58 has not already been held in the case, no such penalty shall be imposed except after an inquiry in the manner laid down in Regulation 58.
